  North Saanich Map - Terms of Use

The following geographic information (North Saanich Map) is provided as a public service by the District of North Saanich on the following terms:
  1. In consideration for the District of North Saanich (the ‘District’) granting access to North Saanich Map, the person (the ‘User’) accessing North Saanich Map agrees to and accepts these Terms of Use.
  2. North Saanich Map is supplied on an ‘as is, where is’ basis. The District assumes no obligation or liability for the use of North Saanich Map by any person and makes no representations or promises regarding the completeness or accuracy of North Saanich Map or its fitness for a particular purpose. North Saanich Map represents a one-time capture of information as it exists at the time the information is transferred to North Saanich Map and does not necessarily include the ongoing updates or corrections to the source databases maintained by the District or other agencies.
  3. The User will use North Saanich Map only for the User’s own internal business and personal purposes and may not Re-sell, sublicense, or operate a service bureau using North Saanich Map, or Otherwise reproduce, publish or disseminate North Saanich Map for commercial purposes, without the prior written consent of the District.
  4. All right, title and interest (including all copyright, patent, and other intellectual property rights) in North Saanich Map remain vested in the District at all times. The District’s notices included with North Saanich Map must remain intact at all times.
  5. The User now indemnifies the District and its officials, employees and agents from and against all loses, claims, demands, actions, payments, expenses, costs, suits, and damages (including any damages that are direct, indirect, incidental, special or consequential), whether or not caused by the negligence of the District, or its officials, employees or agents, which are incurred by the District and would not or could not have been incurred but for the User’s use of North Saanich Map or the User’s breach of these Terms of Use.
  6. Where a conflict between the information on North Saanich Map and information contained in any other records of the District or documents that may be prepared by or delivered to the District, the District reserves the right to rely in all cases upon the record which it considers to be the most accurate and complete.
  7. These Terms of Use are governed by the laws of British Columbia, Canada, and the User now irrevocably agrees that the courts of British Columbia will have exclusive jurisdiction over all matters relating to these Terms of Use. If any part of these Terms of Use are found to be unenforceable, then that part will be severed so that the remainder of these Terms of Use can continue to be enforceable.
  8. Availability of North Saanich Map is not guaranteed. Computer applications, servers and network connections may be unavailable at anytime for maintenance or unscheduled outages. Outages may be of long durations. Do not depend on this service for critical needs.
  9. Failure of the User to comply with these Terms of Use will result in the automatic termination of the User’s rights to access North Saanich Map.
